    Terms and Conditions for Golden Rise Refer a Friend Incentive

    1. Preamble
      1. Mercy Aged and Community Care Ltd (ACN 088 254 460 ABN 77 191 901 062) wishes to offer an Incentive Payment to eligible referrer (Golden Rise Refer a Friend Incentive).
      2. A referrer is eligible for the Incentive Payment if they are:
        1. a current resident in a Golden Rise Stage 1 home; or
        2. a current resident at Mercy Health Bethlehem Home for the Aged; or
        3. a current staff member of Mercy Health.
      3. The Golden Rise Refer a Friend Incentive is offered on these terms and conditions and any additional terms and conditions published by Mercy Aged and Community Care from time to time.
    2. Definitions
      1. Golden Rise Bendigo means the retirement village owned and operated by Mercy Health located at 2 Taylor Street, Golden Square, Bendigo.
      2. Golden Rise Refer a Friend Incentive means the making of an incentive payment for a referral from an eligible referrer to a Prospective Owner
      3. Golden Rise Stage 1 Home means any home located at Golden Rise Bendigo
      4. Golden Rise Stage 2 Home means any of the 22 homes that are currently under construction at Golden Rise Bendigo and part of the development along Conway Court and Coolock Drive.
      5. Incentive Payment means the payment of $2,000.00 to referrers and Prospective Owners as outlined in clause 3.3.
      6. Mercy Health Bethlehem Home for the Aged means the residential aged care facility at 36-42 Specimen Hill Road, Golden Square, Bendigo.
      7. Promotion Period means the period between 9:00am on 1 August 2024 and 11:59pm on 31 October 2024.
      8. Prospective Owner means a person or persons who have been referred by an eligible referrer and has signed a contract of sale for the purchase of a Golden Rise Stage 2 Home.
    3. Redemption Process
      1. A Prospective Owner redeems the Incentive Payment by contacting the Golden Rise Sales office and completing a Golden Rise Refer a Friend Incentive referral form within the Promotion Period.
      2. The Golden Rise Refer a Friend Incentive referral form must:
        1. specify the full name of the referrer;
        2. specify the relationship between the referrer and the Prospective Owner; and
        3. be signed and dated by the referrer and the Prospective Owner.
      3. Incentives will be awarded as follows:
        1. For a referrer who currently lives in a Golden Rise Stage 1 Home: $2,000.00 for the referrer and $2,000.00 for the Prospective Owner.
        2. For a referrer who currently lives at Mercy Health Bethlehem Home for the Aged: a $2,000.00 credit applied to their Mercy Health Bethlehem Home for the Aged account and $2,000.00 for the Prospective Owner.
        3. For current Mercy Health staff: $2,000.00 to the staff member and $2,000.00 to the Prospective Owner.
      4. The Incentive Payment will be paid via Electronic Funds Transfer within 14 business days of settlement of the Golden Rise Stage 2 Home purchased by the Prospective Owner.
      5. By applying for the Golden Rise Refer a Friend Incentive, the referrer:
        1. acknowledges that their participation in the Golden Rise Refer a Friend Incentive is subject to these terms and conditions; and
        2. consents to the collection, use and disclosure of personal information for the purposes of the Golden Rise Refer a Friend Incentive.
    4. General
      1. The Golden Rise Refer a Friend Incentive ends if the Prospective Owner does not effect settlement of the sale of a Golden Rise Stage 2 Home within 5 business days after the settlement date specified in the contract of sale.
      2. If a referrer dies between the date of making the referral and when the Incentive Payment is due, the Incentive Payment will not be paid instead to any members of the referrer’s family or their estate.
      3. Mercy Health reserves the right to decline to make an Incentive Payment to any staff member who becomes a former staff member due to serious misconduct between the period of the referral being received and the Incentive Payment being due.
      4. Benefits arising from participation in the Golden Rise Refer a Friend Incentive are non-transferable and may not be exchanged for cash or any other alternative benefit.
      5. Only one Incentive Payment can apply to a referrer or Prospective Owner. Should there be multiple referrals received, the Incentive Payment will be paid to the eligible referrer based on the referral form with the earliest date.
      6. Mercy Aged and Community Care may amend or revoke these terms and conditions at any time. While Mercy Aged and Community Care will make reasonable attempts to notify referrers of any amendment or revocation of these terms and conditions, it is not required to do so and may alter or revoke the Golden Rise Refer a Friend Incentive at any time.
      7. These terms and conditions shall be governed by and construed in accordance with the laws of Victoria and any disputes arising out of or in connection with them shall be subject to the exclusive jurisdiction of the courts of Victoria.
      8. Mercy Health collects data in accordance with the Mercy Health privacy policy which can be found at https://www.mercyhealth.com.au/legal-policy-information/privacy-policy/.
      9. All data collected and used as part of the Golden Rise Refer a Friend Incentive will be used for the purpose of making Incentives Payments in accordance with these terms and conditions.
